Kinchen Pylant vs Troilus Barnes, guardian Be it remembered that heretofore to wit at a County Court begun and held for the County of Madison at the Court house in the town of Huntsville on the second Monday in February in the year of Our Lord 1828 was returned a writ of Capias adresponderdum in the name of Kinchen Pylant against Troilus Barnes, guardian & C which is in the words and figures following to wit. The State of Alabama To the Sheriff of Madison County - Greeting. You are hereby commanded to take the body of Troilus Barnes, Guardian of Louanzy Harrison, John Harrison and James Harrison wherever he may be found in your County and him safely keep so that you have his body before the Judge of our next County Court to be held for the County of Madison at the Courthouse in the town of Huntsville on the second Monday in February next to answer Kinchen Pylant of a plea of trespass on the case to his damage six Hundred dollars herein fail not and have then and there this writ - Witness Thomas Brandon, Esq. Clerk of said Court, at office this 9th day of November 1827. Endorsed. This suit is brought to recover a sum to wit, $600 in which the defendant stands indebted to the plaintiff for boarding, schooling, & clothing the wards of the defendant at his, the defendants request. Recd 15th January 1828. Jno. P. Neale Shff By his deputy Philip Burford. And now afterwards to wit at the February Term of said Court on the 9th day of said month in the year of Our Lord 1829. This day the plaintiff by his attorney & says he does not wish further to presecute his suit against the defendant & assumes the payment of the costs. It is therefore considered by the court that this suit be dismissed & that the defendant recover of the plaintiff the costs herein expended. These are to authorise you or either of you, to solemnize the rites of matrimony between Kinchin Pilant and Anna Harrison of said county, agreeable to the statute in such case made and provided. Given at the Office of the Register of the Orphan's Court of said county, this 6th day of October 1818. Henry Minor R.O.C. I certify that I solemnized the rites of matrimony between-----blank KNOW ALL MEN BY THESE PRESENTS, That we Kinchin Pilant & Francis Pilant of Madison county, Alabama Territory of the United States, are held and firmly bound unto the Governor of said Territory for the time being, and his successosrs in office, in the sum of two hundred dollars, for the use of said Territory - For the due payment whereof we hereby bind ourselves and our heirs, jointly and severally - Witness our hands and seals, this 6th day of October 1818. The condition of the above obligation is such, that whereas the said Kinchin Pilant hath this day prayed a license from the Register of the Orphan's Court of Madison county, to be married to Anna Harrison. Now if there is no lawful cause to obstruct said marriage, then the above obligation to be void, otherwise to remain in full force. KINCHEN PILANT
