WILL OF ROBERT PILAND OF SURRY COUNTY, VIRGINIA In the name of God amen, I robert Piland of Surry County being sick in body but sound of mind and memory do make this my last Will and testement. Imprimis I recommend my soul to Almighty God who gave it me trusting in the merits of Jesus Christ for justification and redemption. Item I recommend my beloved wife Sally to make my son Benjamin a good and sufficient right and titles in fee simple of it and to the track of land we now possess near Henry Morings in this county at the time she thinks best. Item I give and bequeath to my son Benjamin my sorrel mare named Locket also a man's saddle which is now called his to him and his heirs forever. Item I lend to my beloved wife Sally during her natural life or widowhood the land and plantation whereon I now live and after her death or marriage to be equally divided between my two sons Robert & Thomas to them and their heirs forever. But in case that either of my two sons Robert or Thomas should die under age and unmarried that then my will and desire is that the surviving one shall inherit all the said tract of land. Item I give and bequeath to my beloved wife Sally during her natural life my negro woman Lucy (?Sucky) and at her death to be at her own liberty. Item I give and bequeath to my beloved wife Sally the use of all the remainder part of my estate not before bequeathed during her natural life or widowhood for the purpose of supporting and educating my children but should my said wife marry after my death my will and desire is that then and from thence forth she shall have the use of only one third part of the child's part of the personal estate forever the remainder of the personal estate to be equally divided between all my daughters or their issue. But further should she not marry my will and desire is that the personal estate that may remain at her death, that she shall devise amonst all my children as she shall think most prudent. Lastly I constitute and appoint my beloved wife Sally, my friend John Pyland and John Wesson and my son Benjamin Pyland my whole and sole Executrix and Executors of this my last Will and testement making void all former Wills by me made. In witness whereof I have hereunto set my hand and affixed my seal this 23 day of November anno domi 1795. Signed sealed published and declared to be the last Will and testement of the said Robert Pyland in presence of John H. Judkins, William Davis, Amos Judkins. At a court held for Surry County April 26, 1796. The within written last Will and testement of Robert Pyland deceased was presented in Court by Sarah Pyland and Benjamin Pyland two of the executors named therein and the same being proven by the oaths of John H. Judkins and William Davis witnesses thereto is by the Court ordered to be recorded and on the motion of the said Sarah and Benjamin Pyland who gave bond with Burwell Barham and John Pettway their securities in the sum of 1000 pounds with condition that they will faithfully administer the said decedents estate and made oath agreeably to law whereupon certificate is granted them for obtraining a probate of the said testement in due form and liberty is reserved the other Executors to join in the said probate when they think fit.
