W. H. Pylant and wife vs. Jemimah Davis, May Term 1886. Sarah Pylant and Jemimah Davis hold two parcels of land as equal tenants in common and are entitled to a partition thereof. Partition said land in equal portions and assign one part to Sarah Pylant and the other part to Mrs. Jemimah Davis, so as to give each one the building by them occupied. Jemimah Davis will pay all cost incident to the claim set up by her to the 120 acres for which execution may issue. The cost of the partition will be divided between the parties equally. The court further decrees that Jemimah Davis shall be held to account for the value of rents of the property by her occupied and received since the death of Mrs. Polly Gregory. The basis of said account will be first to ascertain the value of the rents of the 50 acre tract occupied by Mrs. Sarah Pylant and second the value of the rents of 120 acre tract occupied by Mrs. Jemimah Davis and then charge Mrs. Davis with 1/2 of the excess of the rental value of the 120 acre tract to that of the 50 acre tract. The said Mrs. Davis will be chargable with 1/2 of the cross ties, rails and other timbers sold off the 120 acre tract.

<p>Page 575: W. H. Pylant and wife vs. Jemimah Davis, 21 Aug 1886. On 14 July 1886 we set apart for W. H. Pylant and wife the tract of land which they now occupy granted to Rachel Beard by grant no. 9346 containing 50 acres and in addition to the above 50 acres one other addition which is included in the 150 acre grant of Polly Beard no. 1682. This grant by actual survey contains 168 acres instead of 150 acres as shown by the grant. Deducting from the 168 acres 34 3/4 acres the land formerly purchased by Charles Cooke and the 50 acres. The 33 1/4 acres now owned by Charles Cooke and the 50 acres assigned to William H. Pylant and wife leave a balance of 84 3/4 acres now occupied by Jemimah Davis as part of the above lands remaining after deducting the 33 /1/3 acres now owned by Charles Cooke.
